Litigating before the International Court of Justice

The International Court of Justice has been busier than ever, with cases on Gaza, Ukraine, climate change, and many more. But how are cases actually litigated before the Court in practice? How do States present their arguments? What kinds of litigation strategies do they adopt? Are there elements of the Court’s procedure that substantively impact the Court’s decisions? This event explores all these questions and many more.
Peter Tzeng is a partner at Foley Hoag and a visiting fellow at the Graduate Institute’s International Law Department. He regularly litigates cases before the International Court of Justice on behalf of sovereign States. He also represents States in inter-State and investor-State arbitrations, and advises States in treaty negotiations and on matters before the United Nations and other international organizations.
