Nuclear Disarmament in the World Court: The Marshall Islands Cases

On 5 October, the International Court of Justice dismissed three cases brought by the Marshall Islands against India, Pakistan and the United Kingdom. The Marshall Islands had claimed that the three countries (and other nuclear-weapon states) had failed to fulfil their legal obligations to pursue nuclear disarmament. Marcelo Kohen and Nico Krisch will discuss these judgments and the broader relation between law and politics in international affairs.

Professor of International Law at the Graduate Institute, Marcelo Kohen has worked as legal counsel and advocate for a number of states before the International Court of Justice, the International Tribunal for the Law of the Sea and other tribunals. He also acts as an arbitrator. He is generally interested in research related to international law theory, territorial, maritime and border disputes as well as international dispute settlement.

Professor of International Law at the Graduate Institute, Nico Krisch has a particular interest in the legal structure of global governance, the politics of international law, and the postnational legal order emerging at the intersection of domestic, transnational and international law. His most recent work focuses on the changing foundations of international law in a context in which its traditional pillars, especially the consent of states, are increasingly weakened.
