Synergies between the Law of Space and the Law of the Sea, with Dr Michael Byers

This episode features a wide-ranging discussion on a number of synergies — and key differences — between the law of outer space and the law of the sea. Host Catherine Lucas is joined by Dr Michael Byers, Co-Director of the Outer Space Institute, to discuss the common origins of the two regimes, the peaceful uses of outer space, concepts of the “common heritage of mankind”, space mining and deep seabed mining, how the law of the sea has reacted to certain crisis moments and how this might help us deal with potential crisis moments in space, and consider how scholars and practitioners should understand obligations from across international law as applicable to space activities.

Re-entry of Space Objects and the BBNJ, with Dr Vito De Lucia and Dr Jianping Guo

The controlled re-entry of man-made space objects into the Earth’s oceans is commonly known as “splashdowns”. In this episode, host Catherine Lucas is joined by Dr Vito De Lucia and Dr Jianping Guo to explore the practice of splashdowns into areas of the ocean beyond national jurisdiction as they discuss their new article “Assessing before Sinking: The BBNJ Agreement and the Controlled Re-Entry of Space Objects in Marine Areas beyond National Jurisdiction”. Dr De Lucia is Professor of Law at the Faculty of Law, UiT The Arctic University of Norway, and Director of the Norwegian Centre for the Law of the Sea (NCLOS), and Dr Guo is Associate Professor of International Law at Law School, Xi’an Jiaotong University.

Exploring Deep Seabed Mining, with Jessica Battle

For several decades, the deep seabed has attracted growing interest from states and industry for its mining potential, but recent advances in submarine technology and pressure to source minerals for the green energy transition have accelerated that push significantly. At the same time, concerns about environmental impact have led a growing coalition of states and scientists to call for a precautionary pause. Host Malou Estier is joined by Jessica Battle, Senior Expert on Global Ocean Policy and Governance and Lead of the Deep Seabed Mining Initiative at WWF, to explore the tensions at play. Together, they make the case for why we should all be paying attention to what happens thousands of metres below the surface.

This episode discusses the current climate of plastic pollution in the context of the World Trade Organization, specifically the Dialogue on Plastics pollution (DPP). Plastic is a phenomenon that affects all aspects of life, from downstream waste ending up in our oceans to upstream production. Host Katie Bourner and guest Dr Daniel Ramos, a Legal Officer at the WTO and Secretary to the WTO Trade and Environmental Sustainability Structured Discussions (TESSD), explore the history of the DPP initiative and why trade is the essential lever for any meaningful environmental change.
