This project investigates genocide in wartime and clarifies the theoretical and evidentiary issues related to the international responsibility of states and the criminal responsibility of individuals for genocide and other punishable acts, such as complicity in genocide (see Article III of the Convention on the prevention and punishment of genocide). While the Convention prohibits genocide in both peace and war (Article II), the vast majority of genocides occur in the context of armed conflict. The relationship between genocide and the conduct of warfare thus remains conceptually unsettled and legally underexplored.
